There are consequences Wirh blowing a portable breathalizer and then ask for an official test?
i got pulled over for cutting through a parking lot and about 20 minutes before I drank the last quarter or so of my beer, which breathalizers inaccuarate because the alcohol is still fresh in your breath. So I blew one, and they 026 told me that I would only be stuck with a fine and my parents would have to take me home and thats it. But I was wondering, I know you can refuse to take the portable breathalizer and then they take you to the station or a hospital for real. im 100% positive that another 5 minutes my BAC would be less than%, 02 which is the scope for everyone, meaning i cannot get into trouble. after I blew one, 026% on a handheld, I have the right to ask to be taken for the official test, so if I had done that and blew down, 020%, there would be no penalty for me if I would only be allowed to run?
Well my experience is that something like that if youre caught youre caught and it is best not to give them no problems, unless otherwise advised by counsel.
