Passive Alcohol Sensor (PAS)-stronger sense device Delling with Kyllo v. United State?
Kyllo deals via infrared imaging technology to search home of a person from outside. The Supreme Court confirmed it as a search that requires a warrant, because a person a reasonable expectation of privacy in their own home. However, with the PAS devices, there is no reasonable expectation of privacy for your own breath, and in fact most states require giving implied consent is given a Breathalyzer test in state to even have a license, so it's completely constitutional.
