ignition breathalizer
arrested in Alabama for Pub Intox while sleeping in the car without keys in the ignition. No breathalizer done. legal?
I was recently arrested in the Alabama Public Intox while I was sleeping in my car while trying to sober up. I had not locked my keys in the ignition. I was under the understanding that to be charged with public Intox you had a danger to yourself or to someone else. Is this true? If so, I can not see how sleeping is dangerous. Also, no field sobriety tests breathalizers or administered. Is this legal?
It is not true. You just have to be drunk in a public place. requires no sobriety test.
