DUI Lawyer: a sober assessment
Everyone pulled over and arrested on a DUI (driving under the influence) charge is certainly facing a serious crime and a clear record for ten years. Every year in the U.S. nearly half million people are injured as a result of DUI-related highway accidents. Perhaps then, the inevitable sequence events run through your head: loss of driving license, vehicle impoundment, fines and local incarceration, you can be forgiven for thinking DUI = QED.
Ask a DUI lawyer, though, and you hear less about looking to the inevitable consequences of your action, and much more about acting to protect your rights. Never afraid to make a drama from a crisis, you are strongly advised that inaction is simply not a viable option. Destroyed by a DUI conviction record, and in your personal life in ruins, the last thing you want DUI = QED thought. In the doom-laden scenario now presented to you, not a DUI lawyer to take and you will find DUI = RIP.
Let a little more light and less heat into the proceedings, and, hopefully, come to a ruling on when the services of a DUI lawyer. This question can be viewed in two ways. U can broadly in favor of the DUI process, but that you are the victim of injustice because exceptional circumstances or procedural irregularities. Or you might be less optimistic about the whole process of GER, and feel a victim of a criminal law that "normal" people unfairly. Which of these two views you hold determines a large part, if and / or when you ask the services of a DUI lawyer.
In what circumstances would someone who is largely in favor of the DUI process, but he feels injustice served, take the decision to take a DUI lawyer? It could be they believe there was no reasonable grounds for suspicion first place, and therefore their rights were violated and the case against them dismissed. A Breathalyzer test can not be administered before an arrest was made. Even if it had been carried out at the right time, the model, you feel, because it was wrong to set a very high reading which does not correlate with the much smaller amount of alcohol consumed.
The Breathalyzer has another potential problem, too. Even when working properly, it will fail to distinguish between drugs and alcohol as much as older drug-testing procedures used at international sports competitions were unable to distinguish between legal and illegal substances. Problems can also arise with the standardized tests measure DUI perceptual and motor skills. The walking-and-forth one leg stand and horizontal gaze nystagmus should be scored objectively obviating the need, so to speak, for the subjective assessment. What can be interpreted, though, as a failure to perform satisfactorily, would instead be due to unfamiliarity with the test and the stressfulness of the situation.
DUI testing is an inexact science. If you search on this charity, you could say that everyone is fallible, and the subjective element can not be entirely eliminated. On balance, officers get rightmost of time and act with intelligence and integrity, as opposed to drivers who drive recklessly, while road across the border. A driver who has committed a minor offense, registering borderline blood alcohol concentration on what is a very low figure 0.08, feel the same breath as the worst offenders and a sense of shame and embarrassment to hire a DUI lawyer.
But there is another school of thought: the DUI lawyer. Conspiracy theorists are a bunch of optimists compared to these guys. Many drivers convicted for driving under the influence to hold similar views, and the only charity they recognize is the one that begins at home, that is, looking at their license to get back as soon as possible. So what are the costs? Biased officers, on instructions to increase revenues, pull drivers over with no reasonable suspicion to them to stop, deliberate lowering of the alcohol concentration in the blood of the number of people caught in the DUI processes; inflated statistics used to justify draconian laws and increased penalties, and field testing which is specifically designed to officers latitude in interpretation of supposedly "objective" test runs to stand.
Hiring a DUI lawyer would be the action of first resort for those drunk drivers. Demonising the system, the defense strategies easily adopted and pursued in court. Every loophole is exploited in this "nuanced" approach. So, for example, the distinction between having alcohol in the body, but not in the blood, the difference is explained by unnecessary delay between the time of the arrest and blowing into the Intoxilyzer machine. Whether the arresting officer noted your slurred speech and clumsy movements, but failed to mention your ability to hold a conversation with him and stop the car smoothly and upright stand.
The latter examples are given of the DUI lawyer a bad name, "If you did not have time, do not do the crime", many people claim. But the skeptical approach of the law does have its good points. You do not a conspiracy theorist to point protocol and due process must be followed to make. The law is draconian and does not distinguish between small and large events. A revenue-hunting, "get tough" policy on drunk driving is more likely to translate into a questionable police procedures and practices. Improper blowing nozzle for lectures, for some reasons, can lead to wrongful arrest the innocent and wrongly charged.
In light of the above, you are more inclined to give yourself, and not the officer the benefit of the doubt. Maybe a bit more healthy skepticism might serve your interests better: DUI? - It is not necessarily so.
